Requirements for Court Marriage Process in Nepal

Marriage may be concluded between a man and a woman on the following conditions:

(a) If the man and the woman agree to accept each  other as husband and wife,

(b) If the man and the woman are not relatives,  punishable by law on incest,

(c) If a matrimonial relationship of both the man and the  woman does not exist,

(d) If both have attained twenty years of age.

However, the law allows a marriage among people belonging to a certain caste to get married to one’s relative if they culturally accept such practice. Such Couples should register their marriage at the Ward Office of their Permanent Address.

Documents required for court Marriage in Nepal

The Latest list of required documents for Court Marriage in Nepal for Nepali Citizens are:

1. Dully filled and signed application form In the prescribed format;
2. Original and notarized copy of citizenship of applicants;
3. Original and notarized copy of citizenship of certificate of witness
4. Both applicants shall furnish recommendation letters issued from their local wards proving their   unmarried or single status
5.  If applicants is filing an application other than citizenship issuance District, recommendation letters from local ward office for temporary residence.
6.  4 copies of passport-size photos of both applicants.

Documents Required for Foreign & Nepali Citizens (Court Marriage)

The List of Documents required for foreign and nepali citizens to conduct court marriage in Nepal are:

a. No Objection letter from respective embassy or consulate to get married in Nepal. This shall be translated into Nepali by Notary Public.

b. Law relating to marriage in the concerned country. This Act/Law be translated in Nepali and notarized by the  Notary Public.

c. Proof of Foreigner residing in Nepal for a minimum of 15 days

d. Copy of Passport with a valid visa.

Court Marriage Registration Process in Nepal

Step 1- Both applicants duly fill out an application and sign in their respective presence.

Step 2- All the documents are verified by the court authority. After verification, the court registers the application and a day will be scheduled for an appointment.

Step 3- On the scheduled date, both the applicants shall be present in court along with their witnesses.

Step 4- If all the documentation is done properly and all the conditions set in the law are fulfilled, the judge will approve the marriage registration application and the court administration will issue a certificate of the same.
